Employment channel for Green Card
There exist certain fields in which one must fall in to become eligible for achieving the green card through employment:-
Special immigrants
Ones with exceptional abilities or advanced degrees
Skilled or professional workers
Priority workers
Eligible foreign nationals tend to obtain the green card through employment in a much easier way. Excellent performers and researchers are always of a great demand. It is actually the employer who determines the skills of an alien applicant and then decides whether to sponsor him for the green card through employment or no.
Being a part of the multi step process, obtaining green card through employment involves filing of form 750 by the employer. This form is to be submitted with the department of Labor's employment and training administration, it is the DOL only that deny or accepts the labor certification request made by the employer. It depends upon how the employer states and proves the unavailability of a U.S. citizen for a position in his company. If the DOL accepts the certification request, then the same is forwarded to USCIS which the US citizenship and immigration services. Upon getting clearance from this department, a visa number is dispatched which acts as the confirmation to the employee for getting the immigrant visa. This immigrant visa allows the applicant to live and work in U.S. for unlimited period and after completion of his 5 years stay in U.S. he is granted with the Green card through employment.
If the applicant or the employer is not in receipt of the visa number then their case is kept on hold for long till the same is being received.
On receipt of the visa number, the applicant is supposed to visit the local U.S. consulate office where remaining documents are to be submitted and other formalities are to be accomplished.
