Negligence - Who is Responsible?
By: Wendy Moyer | Posted: 29th April 2010
Negligence is a legal term that involves a situation where a person fails to exercise proper care or caution relative to another person's safety. Just about everyone has some kind of responsibility to others. It could be a bus driver going down a city street, a property owner, a manufacturer, a dog owner, a doctor... the list goes on and on.
Now, if any of these people has either acted adversely, failed to act, or failed to provide a reasonable level of care, then the injured party can enter into litigation. And, when defendants are found guilty of negligence by the court, then the plaintiffs may be awarded personal injury settlements.
Personal injury law firms represent their clients on a contingent basis. This means that the attorneys will risk the costs of litigation but not will receive any compensation unless they win the case. For the most part this pretty much assures that frivolous cases will not be represented by a qualified attorney.
Most often personal injury claims involve professional malpractice, carelessness, or recklessness that has resulted in a party or parties being quite seriously injured.
Many attorneys will be prone to represent a potential plaintiff in a personal injury claim if they've been involved in any of these situations:
- An automobile accident
- A boating accident
- A dog bite
- An injury due to medical malpractice or negligence
- A motorcycle accident
- Side effects from a defective drug (prescribed or over-the-counter)
- A slipping and falling accident on someone else's property
- A trucking accident
- Wrongful death (the loss of someone's life because of negligence, intentional wrongdoing, or recklessness)
If you were in an accident or suffered from the effects of wrongly prescribed medicine probably the last thing you're thinking about is hiring an attorney. However, hiring the right attorney can have a major impact on your life and on your case.
Wouldn't it be wonderful if you could just recuperate and not have to worry about medical bills and lost wages? That's how an experienced personal injury law firm can help you.
The best personal injury attorneys, once they agree to represent you, will not only help you to win your case, they will maximize your financial recovery as well. Remember that because they are acting on a contingency basis, the more the court awards you the more they will receive for their knowledge and expertise.
